Federal Mafia takes a toe from Irwin Schiff; continues to ignore its own laws, court rules

Tax honesty icon Irwin Schiff, 77, who last year was sentenced to 12 years in prison by a judge who would not allow "the law" into his courtroom, has filed a Motion for Reconsideration of the U.S. 9th District Court of Appeals one-page denial of Schiff’s 264-page (40-page brief and 224 pages of exhibits) appeal. "Schiff’s contention that his wages do not constitute income under the tax code has been rejected by this court," the 9th ruled.

Schiff, author of numerous books related to the income tax, including the Federal Mafia, has proved that wages and salaries are not taxable as "incomes." But the court prefers to rely on previous decisions justifying the collection of wages and salaries as "incomes" rather than entertain Schiff’s arguments.

Schiff is imprisoned at Fort Dix Federal Pen in New Jersey. Ill-fitted work boots caused an infection to develop in one of Schiff’s toes; poor nutrition and medical neglect carried the infection to the bone and the toe was amputated.

Regardless, Schiff is still ever the optimist. The government has enjoined him from selling his books, but wanted us to mention that some are free for the download at his website at He awaits a response to his Motion for Reconsideration.
