Bond returned in full after non-appearance in traffic court

Though the language used below may seem awkward, read it carefully. This is a traffic stop win. How this man behaved at the traffic stop, how he presented his position to the court and the language used may possibly have exposed a chink in the states' routine traffic stop extortion racket. The catch is that to win you must wage your sovereignty like you mean it -- not just claim it as a right.

ON OCTOBER/25/2001 David-Don: Sego, WAS TRAVELING ALONG HIGHWAY-41 WHEN HE WAS STOPPED BY AN IDAHO-STATE-POLICE-AGENT. David-Don, IMMEDIATELY TURNED ON THE TAPE-RECORDER ON THAT HE WAS CARRYING WITH HIM. THE AGENT APPROACHED David-Don's, CAR AND TOLD HIM HE WAS GOING 72 MILES-PER-HOUR IN A 55 MILE-PER-HOUR-ZONE.

THE AGENT ASKED FOR David-Don's-LICENSE, REGISTRATION, AND INSURANCE. David-Don, TOLD THE AGENT THAT HE WAS PLEADING THE FOURTH AND FIFTH-AMENDMENTS AND THAT HE WOULD-NOT-BE-SHOWING THE AGENT ANYTHING.

THE I.S.P.-AGENT INSISTED THAT THE DRIVERS-LICENSE BE SHOWN-HIM. David-Don: Sego, KEPT PLEADING THE FOURTH AND FIFTH-AMENDMENTS. THIS WENT ON FOR ABOUT FIFTEEN-MINUTES. THE OFFICERS HAND WOULD STRAY TO HIS GUN FROM TIME TO TIME AS AN INTIMIDATION-TACTIC. FINALLY David-Don, AFTER BEING INTIMIDATED THIS LONG SHOWED THE I.S.P. THE INSURANCE-CARD WITH HIS-NAME ON IT. THE AGENT ASKED David-Don IF HE WAS THE NAME ON THE CARD. David-Don, SAID, YES.

THE I.S.P.-AGENT HANDED Don, THE INSURANCE-CARD BACK AND SAID, HERE IS YOUR LICENSE BACK. PLEASE GET OUT OF THE CAR, YOU ARE UNDER ARREST. David-Don, SAID, NO, I HAVE ALREADY-PLEAD MY FOURTH AND FIFTH-AMENDMENTS.

THE I.S.P.-AGENT BEGAN THREATENING BY TELLING David-Don, THAT HE WAS GOING TO BREAK OUT THE WINDSHIELD OF THE CAR AND THAT HE WAS NOT-SAFE IN THE CAR AND THAT WHEN THE DEPUTIES GOT THERE, THAT HE WOULD BE BODILY AND PHYSICALLY REMOVED FROM THE CAR. AFTER A WHILE OF THIS INTIMIDATION David-Don, OPENED HIS-DOOR AND STEPPED OUT. HE WAS IMMEDIATELY-ARRESTED FOR OBSTRUCTING-JUSTICE AND FAILURE TO SURRENDER HIS DRIVER'S-LICENSE.

THE I.S.P.-AGENT INSTRUCTED THE TRAINEE THAT WAS RIDING WITH HIM TO SEARCH David-Don's-CAR. THE TWO OF THEM TOGETHER SEARCHED THE CAR. A LIST WAS MADE OF ALL THE STUFF THAT WAS IN THE CAR EXCEPT THE TAPE-RECORDER, WHICH WAS IN PLAIN-SIGHT.

THE I.S.P.-AGENT KNEW THE RECORDER WAS THERE BECAUSE David-Don, HAD-BEEN-HOLDING THE RECORDER IN THE AGENT'S-FACE THE WHOLE-TIME. THE I.S.P.-AGENT HAD CALLED TO THE BONNER-COUNTY-SHERIFF'S-DEPARTMENT FOR THE BACKUP, AND WHEN IT ARRIVED, THE DEPUTY TOOK David: Don, INTO CUSTODY, PUT HIM IN THE SQUAD-CAR AND TOOK HIM TO THE BONNER-COUNTY-JAIL.

HE WAS TAKEN INTO THE JAIL-BUILDING AND MADE TO GET ON HIS-KNEES, PUT HIS-HEAD DOWN AND PUT HIS-HANDS BEHIND HIS HEAD WHILE A SNIFFING-DOG SEARCHED HIM FOR DRUGS. HE WAS THEN PLACED IN A CELL WHERE, BEFORE THEY WOULD LET HIM MAKE A PHONE-CALL, THEY FORCED HIM TO GIVE HIS SOCIAL-SECURITY-NUMBER. David-Don, WAS FINALLY-ABLE TO CALL HIS-MOTHER WHO ARRANGED FOR THE PAYMENT/BAIL OF THE ALMOST $400.00. PAYABLE TO THE CLERK OF THE COURT.

David-Don's, HEARING WAS SCHEDULED ON THE NOVEMBER/23/2001. ON THE NOVEMBER/20/2001 THE NOTICE FOR THE COURT WAS SENT WITH THE AFFIDAVIT OF THE David-Don: Sego, AND THEN HE DID-NOT-APPEAR IN THE COURT.

David-Don, WAS TOLD BY SOME THAT IF HE DIDN'T-APPEAR THAT THE POLICE WOULD-COME AND ARREST HIM. THEY DID-NOT-COME. AT THE SAME TIME HE NOTICED THE COURT, HE ALSO HAD-FILED THE LAW-SUIT AGAINST THE I.S.P.-AGENT, DEPUTY OF THE SHERIFF'S-DEPARTMENT, THE SHERIFF, AND THE CLERK OF THE COURT OF THE BONNER-COUNTY, IN THE COURT OF THE DISTRICT OF THE U.S.A.. THROUGH THE WORD OF THE MOUTH, David-Don, LEARNED THAT A BENCH-WARRANT WAS OUT FOR HIS-ARREST FOR NOT-APPEARING IN THE COURT. David-Don, THEN NOTICED THE JUDGE OF THE CASE WITH THE FACTS AND A COPY OF THE TAPE, AND THE TRANSCRIPT OF THE TAPE, SENT BY THE CERTIFIED-MAIL-RETURN-RECEIPT.

THIS NOTICE WAS SENT ON THE DECEMBER/10/2001. IT WAS RECEIVED BY THE COURT ON THE DECEMBER/11/2001. IT WAS RESPONDED TO ON THE DECEMBER/12/2001 BY THE DATE ON THE CHECK, AND WITH THE WORDS: “BOND-EXONERATION” AND THE CASE-NUMBER. THE CHECK WAS IN THE David-Don's, HANDS ON THE DECEMBER/15/2001 WITH THE FULL-AMOUNT.
